Liability Waiver
1. Assumption of Risk
I understand that operating a personal watercraft (jet ski) involves inherent and significant risks of property damage, serious bodily injury, paralysis, or death. These risks include but are not limited to: collision with other vessels, swimmers, fixed or floating objects, or the shore; loss of control at high speeds; ejection from the watercraft; drowning; hypothermia; sun exposure; weather conditions; mechanical failure; and the negligence of other operators or third parties. I voluntarily and knowingly assume all such risks, both known and unknown, even if arising from the negligence of Sac.rentals LLC, its owners, employees, or agents.
2. Release and Waiver of Liability
In consideration of being permitted to rent and operate a jet ski from Sac.rentals LLC, I hereby release, waive, discharge, and covenant not to sue Sac.rentals LLC, its owners, members, employees, agents, contractors, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while participating in this activity.
3. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur due to my participation, whether caused by my negligence or otherwise. I further agree to be responsible for any damage to the rented jet ski, equipment, or third-party property caused by me, my passengers, or anyone using the equipment under my rental.
4. Operator Requirements & Safe Operation
I certify that I am at least 18 years of age (or have a parent/guardian signing on my behalf), possess a valid government-issued ID, am physically fit and capable of operating a jet ski, and am not under the influence of alcohol, drugs, or any substance that may impair my ability to operate the watercraft safely. I agree to obey all applicable federal, state, and local laws, U.S. Coast Guard regulations, and all instructions provided by Sac.rentals LLC staff. I will wear a properly fitted U.S. Coast Guard-approved life jacket at all times while on the water, and I will use the engine cut-off lanyard at all times.
5. Damage, Loss & Theft
I accept full financial responsibility for any damage, loss, or theft of the jet ski and accompanying equipment (including trailers, life jackets, lanyards, and fuel) during my rental period, regardless of fault. I authorize Sac.rentals LLC to charge my payment method on file for repair costs, replacement costs, towing fees, salvage fees, fuel, and loss-of-use charges as applicable. Minimum damage deductible and replacement values are disclosed at check-in.
6. No Insurance Coverage
I understand and acknowledge that Sac.rentals LLC does not provide medical, accident, or liability insurance covering me or my passengers. I am solely responsible for my own insurance coverage, including but not limited to health and accident insurance. I understand that my personal automobile or homeowner's insurance may not cover incidents involving personal watercraft.
7. Passengers, Additional Riders & Minors
Any additional riders or passengers must also sign this waiver or be listed on this agreement. Minors (under 18) must be listed below and a parent or legal guardian must sign on their behalf, expressly assuming all risks on the minor's behalf. The undersigned parent/guardian agrees that this release applies fully to the minor and waives any claim the minor may have, to the extent permitted by law.
8. Photo, Video & Marketing Release
I grant Sac.rentals LLC permission to use any photographs, video, or audio recordings taken of me or my party during the rental period for promotional, marketing, or social-media purposes, without compensation. If I do not wish to grant this permission, I will notify Sac.rentals LLC in writing before my rental begins.
9. Governing Law & Severability
This agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising under this agreement shall be resolved exclusively in the state or federal courts located in Sacramento County, California. If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
10. Acknowledgment
I have read this entire agreement carefully, understand its terms, understand that I am giving up substantial legal rights (including the right to sue), and have signed it freely and voluntarily without any inducement, assurance, or guarantee being made to me. I intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
